Several of the terms below, including the governing-law, arbitration, and entire-agreement provisions, also appear in our Terms of Service and are intended to be read together.

FDA Notice and General Safety

The dietary ingredients in this product, including botanical formulations, kratom (Mitragyna speciosa), and 7-hydroxymitragynine derivatives, have not been evaluated or approved by the U.S. Food and Drug Administration (FDA). Products sold by LMTLSS DISTRIBUTION LC are not intended to diagnose, treat, cure, mitigate, or prevent any disease or medical condition. No statements on this website, in packaging, or communications are intended as medical advice or are evaluated by the FDA.

Botanical extracts and active derivatives, including 7-hydroxymitragynine and kratom compounds, may be habit-forming and pose serious risks, including: addiction, dependence, and withdrawal, liver toxicity or damage, seizures, respiratory depression, or sedation, dizziness, nausea, vomiting, or constipation, mental health complications, worsening of substance use or underlying medical disorders, do not use this product if the seal is broken 

IMPORTANT: The concentration of active compounds and alkaloids in specialized tablet formulations or extracts may be significantly higher than standard botanical preparations, increasing overall potency. Please act accordingly and proceed with extreme caution. As with all botanical supplement products, do not use this product without first consulting your doctor. Adverse health effects have been reported with improper use. Publications suggest potential associations with side effects such as seizures, liver stress, withdrawal, addiction, and abuse. Assumption of Risk and Waiver of Liability

You acknowledge that you have read and understood the warnings in Section 2, that active botanical compounds produce physiological effects, and that this product carries serious risks including addiction, dependence, overdose, injury, and health complications, and that you are choosing to purchase, possess, and use it voluntarily and with full knowledge of those risks.

By purchasing, possessing, or using our products, you expressly agree:

You voluntarily and knowingly accept all risks, known and unknown, of every kind, including medical, physical, psychological, legal, and financial risks, arising from the purchase, possession, handling, storage, use, or misuse of these products.

You assume full and sole responsibility and liability for your use, handling, storage, and distribution of these products, and for ensuring that your purchase, possession, and use are lawful where you are located.

You are not relying on any statement, representation, or warranty made by LMTLSS DISTRIBUTION LC or any Released Party in deciding to purchase or use these products.

You hereby waive, release, and forever discharge, and covenant not to sue, LMTLSS DISTRIBUTION LC and its parent, subsidiaries, affiliates, owners, members, managers, officers, directors, employees, contractors, distributors, suppliers, service providers, and agents (“Released Parties”) from any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees), whether known or unknown and whether now existing or arising in the future, arising out of or related to the products or their purchase, possession, use, or misuse, under any legal theory, including negligence, strict liability, product liability, breach of warranty, and failure to warn.

You agree to indemnify, defend, and hold the Released Parties harmless from any claim or demand brought by you or by any third party, including your heirs, estate, family members, or successors, arising out of or related to your purchase, possession, use, or misuse of these products.

This waiver, release, and covenant not to sue is binding upon you and upon your heirs, executors, administrators, successors, and assigns.

To the maximum extent permitted by law, and without limiting the release above, the total aggregate liability of the Released Parties for any claim arising out of or relating to the products or these terms shall not exceed the amount you actually paid for the product or products giving rise to the claim. Any claim or cause of action arising out of or related to the products must be commenced within one (1) year after it arises; otherwise, it is permanently barred, except where a longer period is required by applicable law.

Nothing in this section waives or limits any right or remedy that cannot be waived or limited under applicable law. If any portion of this section is held overbroad, void, or unenforceable, you and we intend that it be modified and enforced to the maximum extent permitted by law, and that the remaining portions remain in full force and effect.

No Medical Claims

LMTLSS DISTRIBUTION LC makes no representations, guarantees, or warranties regarding the therapeutic value, efficacy, or safety of its products. Nothing in this disclaimer or any communication should be treated as a substitute for professional medical advice or treatment.   

Legal Status Notice

You acknowledge that the legal status of specialized botanical products and related substances varies by jurisdiction. Certain states and localities restrict or ban these products. It is your sole responsibility to ensure compliance with all applicable laws before purchase, possession, or use, and you assume all risk and responsibility for any legal consequences of your purchase, possession, or use in any jurisdiction. LMTLSS DISTRIBUTION LC may cancel, restrict, or refuse shipments to prohibited areas at its sole discretion.

Labeling, Quality, and Testing

Products are labeled in accordance with applicable state and federal laws. Formulations and labeling accurately reflect active ingredient parameters and batch specs. Batches undergo quality and purity testing; lab results (COAs) are available upon request. Labels and warnings are subject to updates as law and science evolve.

Terms of Sale

ALL SALES ARE FINAL. No refunds or exchanges unless otherwise required by law or stated in our Refund Policy. We may cancel or refuse transactions at our sole discretion.

These terms are governed by the laws of the State of Idaho. Any disputes will be subject to the jurisdiction of courts located in Idaho, unless otherwise subject to arbitration. (This governing-law provision also appears in our Terms of Service.)

If any provision is deemed invalid, the remainder remains in effect.

Binding Arbitration and Class Action Waiver

⚠ PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

Any and all disputes, claims, or controversies arising out of or relating to your purchase or use of our products, our services, or these terms will be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and governed by the Federal Arbitration Act. The arbitration will be held in Idaho, unless both parties agree otherwise or applicable law requires a different location.

By agreeing to these terms, you and LMTLSS DISTRIBUTION LC waive any right to a trial by jury and any right to participate in a class, collective, consolidated, or representative action. All claims must be brought in the parties’ individual capacities, and not as a plaintiff or class member in any purported class or representative proceeding.

Nothing in this section prevents either party from bringing an individual claim in small claims court for disputes within that court’s jurisdiction.

This arbitration provision survives the termination of your relationship with LMTLSS DISTRIBUTION LC. The same arbitration and class action waiver also appears in our Terms of Service, and the two are intended to be read consistently.

Modification and Severability

We reserve the right to modify these terms at any time. Continued use of our site or products constitutes acceptance of any such changes. If any term is held invalid or unenforceable, the remaining terms shall remain in full force and effect.

Entire Agreement

These Terms, together with any referenced policies, form the entire agreement between you and LMTLSS DISTRIBUTION LC, superseding all prior communications or understandings. A corresponding entire-agreement provision also appears in our Terms of Service.
